  On March 17, according to the NDRC website, the National Development and Reform Commission and the Ministry of Justice issued a notice on "Opinions on Accelerating the Establishment of a Legal and Policy System for Green Production and Consumption." It requires that by 2025, relevant regulations, standards, and policies related to green production and consumption will be further improved, a system framework with effective incentives and constraints will be basically established, green production and consumption methods will be comprehensively implemented in key areas, industries, and links, and China's green development level will be generally improved.

  Promote clean energy development and establish and improve a mechanism to guarantee the consumption of renewable energy. Increase policy support for distributed energy, smart grids, energy storage technology, and multi-energy complementation. Study and formulate standards, regulations, and support policies for the development of new energy sources such as hydrogen energy and ocean energy. Establish and improve policy mechanisms for clean development and utilization of coal, and accelerate the clean development and utilization of coal from the entire life cycle and the entire industrial chain.

  Establish and improve the promotion mechanism for green products such as energy-efficient home appliances, high-efficiency lighting products, water-saving appliances, and green building materials, and new energy vehicles. Where conditions permit, local governments should provide appropriate support to consumers for purchasing energy-efficient home appliances, energy-saving new energy vehicles, and water-saving appliances. Encourage the use of new energy and clean energy vehicles for newly added and updated vehicles in the fields of public transportation, sanitation, taxis, commuting, urban postal and express delivery operations, and urban logistics.

  Opinions on Accelerating the Establishment of a Legal and Policy System for Green Production and Consumption

  Promoting green production and consumption is an important part of building an ecological civilization and achieving high-quality development. The Central Committee of the Communist Party of China and the State Council attach great importance to this. Since the reform and opening up, especially since the 18th National Congress of the Communist Party of China, China has introduced a series of regulations and policy measures in the field of green production and consumption, vigorously promoting green, circular, and low-carbon development, accelerating the formation of a production and lifestyle that saves resources and protects the environment, and has achieved positive results. However, it must also be seen that the regulations and policies in the field of green production and consumption are still not sound, and there are still problems such as insufficient incentives and constraints and lack of operability. In order to accelerate the establishment of a legal and policy system for green production and consumption, the following opinions are put forward.

  I. Overall Requirements

  (1) Guiding ideology. Guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, fully implementing the spirit of the 19th National Congress of the Communist Party of China and the second, third, and fourth plenary sessions of the 19th Central Committee, deeply implementing Xi Jinping's ecological civilization thought, adhering to the people-centered approach, implementing the new development concept, and following the principles of problem orientation, highlighting key points, systematic coordination, applicability, feasibility, and gradual progress, accelerate the establishment of a legal, standard, and policy system related to green production and consumption, promote source reduction, clean production, resource circulation, and end-of-pipe treatment, expand the consumption of green products, and promote the formation of green production and consumption methods throughout society.

  (2) Main goals. By 2025, relevant regulations, standards, and policies related to green production and consumption will be further improved, a system framework with effective incentives and constraints will be basically established, green production and consumption methods will be comprehensively implemented in key areas, industries, and links, and China's green development level will be generally improved.

  II. Main Tasks

  (3) Promoting green design. Improve the policy mechanism for promoting green design. Establish a grading quality control and labeling system for recycled resources, and promote the use of recycled resources products and raw materials. Improve the priority control list of chemicals, and guide enterprises to use non-toxic, harmless, low-toxic, low-harm, and environmentally friendly raw materials in the production process. Strengthen the unified planning of standard formulation, strengthen the construction of the green standard system, expand the coverage of standards, accelerate the formulation and revision of relevant standards in key areas, and improve standards and design specifications according to actual conditions.   (4) Strengthening industrial clean production. Strictly implement the Clean Production Audit Measures and the Clean Production Audit Assessment and Acceptance Guidelines, further standardize clean production audit practices, and ensure the quality of clean production audits. Introduce policy measures to further promote mandatory clean production audits in key industries. Improve the clean production evaluation index system for key industries and implement a dynamic adjustment mechanism. Improve the differentiated electricity price policy based on energy consumption and pollutant emission levels, and support key industry enterprises in implementing clean production technology transformation. Formulate encouraging policies to support the research and development and manufacturing of clean production equipment in key industries.   (5) Developing a circular industrial economy. Improve relevant support policies and promote the circular transformation of existing industrial parks and the circular construction of new parks. Improve support policies for the comprehensive utilization of associated minerals, tailings, industrial "three wastes", and waste heat and waste pressure. Focusing on electrical and electronic products, automotive products, power batteries, lead-acid batteries, and beverage paper-based composite packaging, accelerate the implementation of the extended producer responsibility system, and expand the implementation scope to tires and other varieties in due course, strengthening the responsibility of producers for the recovery and disposal of waste products. Support the establishment of a recycling and remanufacturing system for used automotive parts such as engines and gearboxes, and improve the policy for scrapping and updating motor vehicles. Establish and improve a standard and policy support system for green exploration and green mines. Establish and improve policy mechanisms for water conservation and efficiency improvement in high water-consuming industries.   (6) Strengthening industrial pollution control. Fully implement the pollutant discharge permit system and strengthen the legal responsibilities of industrial enterprises for pollution prevention and control. Accelerate the formulation of feasible technical guidelines for pollution control, formulate and revise pollutant discharge standards according to the principles of stability, continuity, controllability, and attainability, strictly enforce environmental protection law enforcement supervision, achieve full compliance with discharge standards from industrial pollution sources, and encourage compliant enterprises to implement in-depth treatment. Improve supporting policies for hazardous waste centralized disposal facilities and sites as public environmental protection facilities. Establish and improve a clear responsibility, reasonable procedure, and scientifically standardized early warning and emergency mechanism for ecological and environmental emergencies, and establish a post-assessment mechanism for ecological and environmental emergencies. Improve the working system for judicial identification of environmental damage from industrial pollution, establish and improve the coordination mechanism between administrative management agencies, administrative law enforcement agencies, supervisory agencies, and judicial agencies, promote the sharing of punishment information and monitoring information in the field of industrial pollution control, give full play to the public interest functions of procuratorial organs, and form a diversified pattern of industrial pollution control.   (7) Promoting clean energy development. Establish and improve regulations and policies that are compatible with the large-scale development of renewable energy. According to the principles of simplification, universality, stability, and gradual change, make corresponding regulations and policy adjustments in terms of planning and coordination, grid connection and consumption, and price mechanisms, and establish and improve a mechanism to guarantee the consumption of renewable energy power. Increase policy support for distributed energy, smart grids, energy storage technology, and multi-energy complementation. Study and formulate standards, regulations, and support policies for the development of new energy sources such as hydrogen energy and ocean energy. Establish and improve policy mechanisms for clean development and utilization of coal, and accelerate the clean development and utilization of coal from the entire life cycle and the entire industrial chain. Establish a mechanism for evaluating the entire life cycle of energy consumption, emissions, and costs in the links of energy development, production, trade, transportation, equipment manufacturing, and conversion and utilization.   (8) Promoting Green Development in Agriculture. Guided by green ecology, we will innovate the体制机制 for green development in agriculture, and construct a supporting system for green agricultural development, innovating the technological system, improving the standards system, extending the industrial system, strengthening the operational system, and improving the policy system to provide support for the green development of agriculture. We will vigorously promote scientific fertilization and establish a policy mechanism for the promotion of organic fertilizer to replace chemical fertilizer. We will implement a plan to reduce and replace chemical pesticides and establish a policy mechanism for promoting biological control to replace chemical control, supporting the research and development and promotion of green pest control technologies and products for crops. We will formulate management methods for agricultural films, establish a comprehensive supervision system, and support the promotion of biodegradable films. We will accelerate the formulation of management methods for the recovery and disposal of pesticide packaging waste. We will improve the system for comprehensive utilization of crop straw, and comprehensively promote the full utilization of straw at the county level. With fertilization and energy utilization as the main directions, we will implement the system for the resource utilization of livestock and poultry manure. We will improve and implement green development policies for aquaculture, and strengthen the unified planning of aquaculture waters and滩涂 in accordance with the law. We will establish standards for the use of feed additives and veterinary drugs, and improve the mechanism for the harmless treatment of dead livestock and poultry. We will steadily promote pilot programs for crop rotation and fallow. We will improve the promotion system for agricultural circular economy and establish a mechanism for the promotion of green agricultural production technologies. We will implement tax support policies for the green development of agriculture. We will establish and improve relevant standards for the green development of agriculture and accelerate the cleanup and abolition of standards and industry norms that are not compatible with the green development of agriculture.   (9) Promoting Green Development in the Service Industry. In the planning, construction, operation, and management of municipal public works facilities and urban and rural public living service facilities, we will fully implement the concept of green development and improve the level of greening. We will improve support policies for the construction of green logistics. We will accelerate the establishment and improvement of legal, standard, and policy systems for green packaging in the fields of express delivery, e-commerce, and food delivery, reduce excessive packaging and the use of disposable products, and encourage the use of degradable and recyclable packaging materials and logistics equipment. We will improve the management and technical specifications for the classification, recycling, and utilization of recyclable resources.   (10) Expanding the Consumption of Green Products. We will improve the certification and labeling system for green products. We will establish and improve a quality standard system for comprehensive utilization products of solid waste. We will implement tax preferential policies to support energy-saving, water-saving, environmental protection, and resource comprehensive utilization industries. We will actively implement the government procurement system for green products, combine the implementation of product catalog management, and increase the application of relevant standards for green products in government procurement. State-owned enterprises will take the lead in implementing the guidelines for corporate green procurement and establishing and improving green procurement management systems. We will establish and improve a promotion mechanism for green products such as energy-efficient home appliances, high-efficiency lighting products, water-saving appliances, green building materials, and new energy vehicles. In areas with conditions, appropriate support will be given to consumers for purchasing energy-efficient home appliances, energy-saving new energy vehicles, water-saving appliances, etc. We will encourage the adoption of new energy and clean energy vehicles for newly added and updated vehicles in areas such as public transportation, sanitation, taxis, commuting, urban postal express operations, and urban logistics.   (11) Promoting Green Lifestyles. We will improve the tiered pricing policies for residents' electricity, water, and gas consumption. We will implement the wastewater treatment charging system and adjust the wastewater treatment fee standard to compensate for the operating costs of wastewater treatment and sludge disposal facilities and achieve reasonable profitability. We will accelerate the implementation of the system for the classification and resource utilization of urban and rural residents' domestic garbage. We will formulate policy measures to further strengthen the governance of plastic pollution. We will research and formulate regulations on the management and resource utilization of kitchen waste. We will promote green rural housing construction methods and technologies and gradually establish and improve a mechanism for rural housing construction using green building materials and constructing green rural houses.   III. Organization and Implementation

  In accordance with the decisions and deployments of the Central Committee of the Communist Party of China and the State Council and the needs of reform, we will comprehensively promote the work of establishing, revising, abolishing, and interpreting laws and regulations in the fields of green production and consumption. Relevant departments should, in accordance with their respective duties, accelerate the progress of the formulation and revision of relevant laws, regulations, standards, and policies. Various regions should, in accordance with the requirements of this opinion, combine actual conditions to introduce regulations, standards, and policies to promote green production and consumption in their regions, encourage pilot projects, and summarize and promote experience. All levels of finance, taxation, and finance departments should continuously improve support policies in the field of green production and consumption. All levels of propaganda departments should organize the media to use various channels and methods to vigorously publicize and promote the concept of green production and consumption, increase the publicity of relevant laws, regulations, and policy measures, build a social consensus, and create a good atmosphere.
